Overview
Aviation law is the branch of law concerning flight, air travel, and the associated legal and business issues that arise from them, overlapping in some areas with admiralty law and often treated as a matter of international law given the inherently cross-border nature of air travel. The business and regulatory aspects of airlines also fall squarely under aviation law, spanning everything from route licensing and safety regulation to passenger rights and liability in the event of an accident. Internationally, the International Civil Aviation Organization (ICAO), a specialized United Nations agency, provides general rules and mediates international aviation law concerns to a significant extent. In the United States and most European nations, aviation law is treated as a federal or state-level matter, regulated at that level even though the underlying activity — international air travel — frequently crosses multiple national jurisdictions in a single flight.
History
Formal aviation law began developing almost immediately after powered flight became practical, as governments recognized the need for legal frameworks covering airspace sovereignty, aircraft registration, and liability for accidents. The 1919 Paris Convention represented one of the earliest international aviation law agreements, establishing basic principles of national airspace sovereignty that remain foundational to international aviation law today. The 1944 Chicago Convention significantly expanded international aviation law, establishing the International Civil Aviation Organization and creating a much more comprehensive framework for international civil aviation regulation and cooperation. Aviation law has continued evolving substantially since, addressing new challenges including commercial space travel, drone regulation, and passenger rights, reflecting how the underlying technology and business of aviation has continued to expand well beyond what early 20th-century aviation law originally anticipated.
